Here are two examples of bringing creative thinking and legal theory into play to help our clients: One of our clients was the first person to be charged under a statute that made engaging in a lewd act within 1000 feet of a church or a school a felony rather than a misdemeanor. We pondered the statute until we realized that something was not quite right about it. After a short time, we realized that the statute provided enhanced protection specifically to Christians and others who attend church. It did not afford the same protection to Moslems who attend mosques or members of the Jewish faith who attend synagogues. Therefore, it violated the First and 14th Amendments of the United States Constitution. We filed the appropriate paperwork, and the charge was reduced to a misdemeanor. A lawyer needs to really look at the fine details of every case, including the specifics related to the laws involved, as well as jurisdictional matters. We had a client who was arrested in Oklahoma with 300 pounds of marijuana in his trunk. While out on bail, the same client was caught again, this time in Ohio with over 700 pounds of marijuana. In Oklahoma state court, drug crimes carry the prospect of severe punishments. In fact, for the original 300 pounds, our client faced the possibility of life in prison. The prosecutor was “generous” enough to offer the client 40 years in prison. We looked over the details and discovered two important pieces of information. First, federal court is much more lenient in these situations than state court in Oklahoma. Second, Oklahoma law prevents someone from being prosecuted for a drug crime that they have already been prosecuted for in another state or in federal court. Through the appropriate maneuvering, our client served less than 4 years in jail for the full 1,000 pounds of marijuana, rather than the original 40 years he was offered.
